1. General Terms
These Terms and Conditions govern the relationship between the Merchant and the users/customers of the online store bodymarblemagic.com when concluding distance sales contracts within the meaning of the Bulgarian Consumer Protection Act.
By registering and/or clicking the "Buy" button, the user declares that they have read these Terms and Conditions, fully accept them, and undertake to comply with them.
2. Identification of the User/Customer
The user is identified through the information provided during registration and/or placing an order, as well as through the server log files of bodymarblemagic.com (IP address, date, and time), insofar as this is necessary for the performance of the contract and for proving the statements made.
3. Products
The products published on bodymarblemagic.com constitute an invitation to make an offer and do not represent a legally binding offer. Product descriptions and photographs are for informational purposes only.
4. Conclusion of the Contract
The distance sales contract shall be deemed concluded upon confirmation of the order by the Merchant via email or another electronic means.
5. Product Availability
If an ordered product is out of stock, the Merchant shall notify the customer within a reasonable period. If advance payment has been made, the customer may choose between a refund or a replacement order.
6. Language and Currency
The contractual language is Bulgarian. All prices are in euros (EUR) and include VAT unless expressly stated otherwise.
II. DELIVERY
7. Risk upon Delivery
The risk of loss of or damage to the goods passes to the consumer upon receipt of the goods. If the consumer chooses a carrier other than the one offered by the Merchant, the risk passes upon delivery of the goods to that carrier.
8. Inspection of the Goods
The consumer is obliged to inspect the goods upon delivery and immediately notify both the courier and the Merchant of any visible discrepancies or damage.
9. Refusal to Accept Delivery
An unjustified refusal to accept a shipment results in the customer's obligation to pay the costs incurred for both delivery and return of the shipment.
III. PRICES AND PAYMENTS
10. Prices
The prices displayed on the website are final and include VAT. Delivery costs are stated separately unless free delivery is expressly announced.
- Delivery to an Econt office is free of charge if the order value exceeds EUR 400 and the shipment weighs up to 7 kg. If the customer requests delivery to an address, the delivery costs shall be borne by the customer. In the event of a product replacement or correction due to a defective product or a product not corresponding to the order, delivery costs in both directions shall be borne by the Merchant. If the product is returned at the customer's request without any defect, the return shipping costs shall be borne by the customer.
- The prices displayed on the website may differ from those in physical stores. Certain products may be available exclusively through the online store at different prices. Differences may also occur due to promotions, special offers, discounts, or other campaigns conducted separately in the online store and in physical stores.
IV. RIGHT OF WITHDRAWAL AND COMPLAINTS
11. Right of Withdrawal
The consumer has the right to withdraw from the contract within 14 days of receiving the goods, in accordance with the Bulgarian Consumer Protection Act. The conditions and procedure are described in the "Refund Policy" section.
12. Complaints
Complaints shall be submitted in accordance with the requirements of the Bulgarian Consumer Protection Act and are described in the "Complaints" section.
V. PERSONAL DATA
Personal data shall be processed in accordance with the Privacy Policy published on the website.
VI. INFORMATION UNDER ARTICLE 47 OF THE BULGARIAN CONSUMER PROTECTION ACT
In accordance with Article 47 of the Bulgarian Consumer Protection Act, the Merchant provides consumers with the following pre-contractual information before concluding a distance contract:

5. Payment Methods
Payment may be made using the methods expressly indicated in the online store at the time the order is placed.
6. Delivery and Performance Conditions
Goods are delivered by courier to the address or courier office specified by the consumer. Delivery times are indicative and depend on the selected courier.
7. Right to Withdraw from the Contract
The consumer has the right to withdraw from the contract within 14 days of receiving the goods without providing any reason, except in the cases provided for under Article 57 of the Bulgarian Consumer Protection Act. 8. Costs upon Withdrawal
The costs of returning the goods when exercising the right of withdrawal shall be borne by the consumer unless the Merchant has expressly agreed to bear such costs.
9. Liability for Lack of Conformity
The Merchant shall be liable for any lack of conformity of the goods with the contract in accordance with the provisions of the Bulgarian Consumer Protection Act.
10. Warranties
Information regarding commercial warranties, where provided, is stated in the description of the respective product.
11. Duration of the Contract
The contract is concluded for a single purchase transaction and terminates upon its performance.
12. Functionality of Digital Content
Where applicable, information regarding the functionality and compatibility of digital content is provided in the product description.
13. Alternative Dispute Resolution
Consumers may use the European Commission's Online Dispute Resolution (ODR) platform as well as the conciliation commissions operating under the Bulgarian Consumer Protection Commission.
VII. AMENDMENTS AND FINAL PROVISIONS
The Merchant reserves the right to amend these Terms and Conditions by publishing the updated version on the website.
Any matters not governed by these Terms and Conditions shall be subject to Bulgarian law. All disputes shall be resolved by the competent Bulgarian court.
